Setting up a Business in Thailand

The following is an overview of establishing a business in Thailand.

As in most countries, there are three kinds of business organizations in Thailand: Sole proprietorships, partnerships, and limited companies. The most popular form of business organization among foreign investors is the private limited company.
Private limited companies require a minimum of seven promoters and must file a memorandum of association, convene a statutory meeting, register the company, and obtain a company income tax identity card. They must also follow accounting procedures specified in the Civil and Commercial code, the Revenue Code and the Accounts Act. A balance sheet must be prepared once a year and filed with the Department of Revenue and Commercial Registration. In addition, companies are required to withhold income tax from the salary of all regular employees.

General Guidance for Foreign Nationals wishing to marry in Thailand

Please note this information is provided only as general guidelines.

1. Regulations for marriage under Thai Law are as follows

- A couple must be of legal age (17 years) upon filing for marriage registration, otherwise permission must be granted by a court.

- Permission from the parents is required for parties under legal age.

- Both parties must not be registered as married to anyone else (Multiple marriage registration is prohibited).

- The parties must not be direct blood relatives nor be sister or brother through either parent.

- Adopting parents shall not be permitted to marry their own adopted child.

- A widow or divorcee will be permitted to remarry not less than 310 days after the previous marriage has expired, unless:

1. Has given birth to a child.

2. Remarrying the same person.

3. Not pregnant, as certified by doctor. (in case of early remarriage)

4. Approval to remarry from a court is obtained.

Education in Thailand

Education in Thailand is provided mainly by the Thai government through the Ministry of Education from pre-school to senior high school. A free basic education of twelve years is guaranteed by the constitution, and a minimum of nine years’ school attendance is mandatory. Formal education consists of at least twelve years of basic education, and higher education. Basic education is divided into six years of primary education and six years of secondary education, the latter being further divided into three years of lower- and upper-secondary levels. Kindergarten levels of pre-primary education, also part of the basic education level, span 2–3 years depending on the locale, and are variably provided. Non-formal education is also supported by the state. Independent schools contribute significantly to the general education infrastructure. Administration and control of public and private universities are carried out by the Ministry of University Affairs.

Procedure on the Issuance of Thailand Retirement Visa (Non Immigrant O-A Visa)

On 11th September 2001 the Cabinet has approved the revision of the regulation on granting the authorities concerned to facilitate the issuance of visa to foreigners aged 50 or above wishing to retire in the Kingdom of Thailand at least for the period of one (1) year.

Qualification of an applicant

  1. A foreign national whose age is over 50 years or above
  2. Must be able to present the financial evidence between:
    2.1  THAILAND BANK ACCOUNT SHOWING THB 800,000 (must be able to show the evidence of transfer the   money to your Thai Bank account and this sum of money must be depositted in your bank account at least 2-3 months) OR
    2.2 PENSION/MONTHLY INCOME OF AT LEAST THB 65,000 (must present a letter from your embassy to prove the pension and the letter from the government or social security) Both of documents must be certified by your embassy in Bangkok as well.
  3. Not being prohibited from entering the Kingdom under the Immigration Act B.E.2522 (A.D.1979)
  4. No criminal record of the Kingdom of Thailand, the country of national and country of permanent residence as well.
  5. Holding the nationality or permanent residence of the country of application
  6. No medical record of contagious disease.
  7. No permission of working in Thailand.

WORK PERMIT FOR THAILAND

Initially, before able to apply for a work permit for Thailand, a foreign citizen must have a Thailand Non Immigrant B, O, M, RS Visa which issued by a Royal Thai Embassy or Thai Consulate or Thai Immigration Office.
Qualifications of a foreign citizen who wants to apply for a Thai work permit:

1. Having residence in the Kingdom or having permission to stay in the kingdom temporarily under immigration law. (only Thailand Non Immigrant B, O, M, RS Visa is acceptable)
